Starting A Business: The Basics By the time you read this you have already made the decision to start a business. You are confident you possess the skills, knowledge and experience to succeed. You have considered the financial aspects of your proposed venture and you are ready to get the ball rolling. Step 1: Where Do I Begin Virtually any new business in Oregon requires some communication and filings with the Oregon Secretary of State’s Office. You should also contact both the county and city in which you will locate the business for additional requirements. These can include, among other things, a business license. Step 2: Choosing a Structure There are several different ways to structure your business. Each structure has specific implications and requirements. The structure you select will have many important ramifications for your company. Step 3: Choosing a Name & Brand Protection Choosing a name sounds simple, but it is a step many overlook. First, the structure you select may require certain identifications. This includes designation as “Inc.” or “LLP”. It is also important to search the directory of names to be sure your desired name is not taken. One step often overlooked, especially by new a business, is brand protection. Establishing your brand in a way to protect the name and image is important at the earliest stages of operations. Failing to search for potential conflicts can result in severe consequences to your company. Just as dangerous is failing to periodically search for infringing companies. Step 4: What Next? There are many other issues that are very important to review. The Oregon Secretary of State office provides many materials to assist with the process. Some specific items to consider include Do you need a professional license? Are you familiar with Oregon’s Employment laws? Are there zoning restrictions that could affect your business?
